Terms of service

These Terms of Service ("Terms") govern the websites and services provided by [GABBI PTY LTD] ABN [35 698 322 842] ("GABBI PTY LTD", "we", "us"). By requesting a preview, signing up, or using our service, you ("you", "the client") agree to these Terms.

1. Our service

Gabbi builds and maintains professional one-page websites for service businesses. Your plan includes design and build, a custom domain, managed hosting, a business email address, mobile-responsive design, Google Business Profile setup, basic analytics, and ongoing updates and support, as described on our website at the time you sign up.

2. The free preview

Before you commit, we build a free working preview of your website. The preview is provided at no cost and with no obligation — you are free to walk away. The preview remains our property until you proceed to a paid plan; you may not publish, copy or use the preview unless you sign up.

3. Pricing and payment

  • Our pricing is a one-off setup fee of [$399] plus a recurring fee of [$149] per month.

  • Prices are in Australian dollars and [include / exclude] GST.

  • The setup fee is payable before your site goes live. The monthly fee is billed [monthly in advance] from your go-live date.

  • Payments are processed by [Stripe / your payment provider]; their terms also apply.

  • If a payment fails or is overdue, we may pause or suspend your site after giving you reasonable notice.

4. Timeline

We aim to have your site live within 7 days of you approving the design. This timeframe depends on you providing the content, images and approvals we need promptly. Delays in providing these may extend the timeline.

5. Your responsibilities

You agree to:

  • provide accurate information about your business;

  • supply content and feedback in a timely way;

  • ensure you own, or have permission to use, any text, images, logos or other materials you give us; and

  • not use the website for anything unlawful, misleading or harmful.
    You are responsible for the accuracy of the content you ask us to publish.

6. Your domain — always yours

Your domain name belongs to you. We register or transfer it in your name, and it remains yours. If you cancel your plan, your website will go offline, but you keep your domain name. We will take reasonable steps to assist with transferring control of the domain to you or your nominated provider on request.

7. Hosting and email

Hosting and your business email are provided as part of your monthly plan and are active only while your plan is active. If your plan ends, hosting and email associated with the plan will cease, though your domain remains yours (see clause 6).

8. Cancellation and no lock-in

  • There is no lock-in contract. You may cancel at any time with [reasonable / 30 days'] notice.

  • On cancellation, your site goes offline at the end of your current billing period, your monthly billing stops, and you keep your domain.

  • The setup fee covers work already performed and is non-refundable once work has begun, except where a refund is required by law. Monthly fees already paid for the current period are not refunded, except where required by law.

9. Intellectual property

  • Once your setup fee and first payment are made, you own the published content of your website (your text, your images, and the final design as delivered to you).

  • We retain ownership of any underlying templates, code, components, systems and know-how we use to build sites, and of any third-party assets, which remain subject to their own licences.

  • We may showcase your website as an example of our work (for example in a portfolio or marketing), unless you ask us in writing not to.

10. Support and updates

Reasonable updates and ongoing support are included in your plan. "Reasonable" means routine content changes and minor adjustments; substantial redesigns, additional pages, or new functionality beyond your original plan may be quoted separately. We'll always tell you in advance if something falls outside your plan.

11. Third-party services

Our service relies on third-party platforms (including [Framer] for hosting, [Google Workspace] for email, your domain registrar, and [Stripe] for payments). Their services are subject to their own terms, and we are not responsible for outages or changes outside our control. We'll do our best to keep your site running smoothly.

12. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits those rights. To the extent permitted by law, our other warranties are excluded, and our liability for any breach is limited to re-supplying the service or the cost of doing so.

13. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect or consequential loss (including loss of profits, business or data) arising from the website or our service. Our total liability is limited to the fees you have paid us in the [12] months before the claim.

14. Privacy

We handle your personal information in line with our Privacy Policy, which forms part of these Terms.

15. Changes to these Terms

We may update these Terms from time to time. We'll post the current version on our website with an updated date, and significant changes will be communicated to active clients.

16. Governing law

These Terms are governed by the laws of [Victoria], Australia, and the courts of [Victoria] have jurisdiction.
